Terms & Conditions
Introduction
These Terms & Conditions are applicable to all relations between the Developer, the Client and the Agent in regard to the purchasing process of the properties that are or will be constructed by the Developer.
1. Definitions:
In these Terms, the following expressions shall have the meanings set against them herewith, unless it is specifically redefined in the context:
a. “The Developer” means Tzarski Zaliv Ltd
b. “The Client” means company, firm or individual who/which shows an interest in purchasing a property or who/which is agreed to purchase property;
c. “The Agent” means
d. “The property” means the apartments in the building project: Costa Bulgara Mediterranean Club
e. “The purchase” means the process of transfer of title of deeds
2. Reservation
- Upon reservation a deposit of EURO 2000.00 is required, which deposit will be retained if the Client withdraws before the signing of the preliminary contract. The property is reserved removed from the availability list for 30 days from the date of receiving the money.
- Upon reservation the Agent will require personal details of the Client such as:
a. Full Name
b. Passport number, date of issue and expiry and a photocopy of the passport page with the personal details
c. Current address
d. Telephone number for contact
e. E-mail
f. These details are required for the preparation of the preliminary contract for purchase and the Agent shall give them to Developer
3. Preliminary contract
- If the Agent provides the reservation fee and the Client’s personal details specified in point 2.2, the Developer must provide a preliminary contract along with a confirmation letter, confirming the amount of first instalment and specifying the bank account of the Developer within 5 days of receiving the reservation fee.
- Client must sign and send back the preliminary contract to Developer through the Agent by fax. Therefore, the Agent arranges the original copy to be sent by post with advice of delivery to Developer.
- After signing the preliminary contact the Client must transfer the amount of first instalment (minus the reservation fee) as specified in condition 3.1, but not later then 30 days of reservation fee.
- If the Client fails to make the first instalment within 30 days of the date of reservation fee payment, the Developer has the right to cancel the reservation and to offer the property to another Client.
- Upon receiving the first instalment the Developer provides a duly signed and stamped receipt of payment, whereas a copy is sent to the Client and the Agent, while the original is sent by post with advice of delivery.
4. Stage of completion and further instalments
- On each stage of completion the Developer provides the Client, through the Agent, with Instalment Letter, Certificate of Completion, and photographs, confirming the stage of completion.
- The Client must transfer the relevant instalment amount to Developer within 10 banking days of the date of receiving of the Instalment lette
5. Final completion at Notary
- A purchase is formally completed when the title deeds of purchase are signed before the notary, the final payment is made and the Client has the right to take possession of the real estate.
- Upon completion of the development the Client shall pay the instalment/s due according to the preliminary contract.
- The Developer provides the client, through the Agent, with a set of documents for the completion at Notary.
- Within 14 days of the last instalment paid the title deed of purchase are signed before the notary, and the Client has the right to take possession of the real estate.
6. Prices
- The property prices are shown and paid in EURO only.
- The property prices are with VAT.
7. Means of payment
1. The Client shall pay the money due on any stage of completion in one or more of the following ways:
a. bank transfer to a bank account nominated by the Developer
b. bank transfer to a bank nominated by the Agent (applied to reservation fee only)
c. cheque payable to the Agent (applied to reservation fee only, unless the Developer has given other explicit instructions)
